L&#8217;article 1089 du Code civil du Qu\u00e9bec a fix\u00e9 ce quorum lorsqu&#8217;une majorit\u00e9 des voix  copropri\u00e9taires sont pr\u00e9sents ou repr\u00e9sent\u00e9s par procuration. Les proc\u00e8s-verbaux des assembl\u00e9es font partie des documents qui doivent figurer dans le registre du syndicat comme l\u2019indique l\u2019article\u00a01070 du Code civil du Qu\u00e9bec. Or, tout copropri\u00e9taire est en droit de demander d\u2019avoir acc\u00e8s \u00e0 ce m\u00eame registre (art. 1070.1 C.c.Q.). C&#8217;est \u00e9galement \u00e0 ce dernier que revient le droit de voter. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Un copropri\u00e9taire a cependant le droit de d\u00e9l\u00e9guer ce pouvoir \u00e0 son locataire en signant une procuration. Ce droit peut cependant vous \u00eatre retir\u00e9 si vous n&#8217;avez pas pay\u00e9 votre part aux charges communes ou au fonds de pr\u00e9voyance depuis plus de trois mois (art. 1094 C.c.Q.).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Il est \u00e9galement normal de voir et m\u00eame d&#8217;entendre les administrateurs et le gestionnaire assister aux assembl\u00e9es m\u00eame si ces derniers ne sons pas des copropri\u00e9taires.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bien que le lieu choisi pour la tenue d&#8217;une assembl\u00e9e est consid\u00e9r\u00e9 comme \u00e9tant un lieu public au sens de l&#8217;article 15 de la charte des droits et libert\u00e9, seul les copropri\u00e9taires, administrateurs et gestionnaire y ont en principe acc\u00e8s. Cependant, les autres occupants de l&#8217;immeuble comme les conjoints et locataires peuvent \u00eatres autoris\u00e9 par l&#8217;assembl\u00e9e. Il en va de m\u00eame pour des professionnels invit\u00e9s \u00e0 y faire une pr\u00e9sentation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bien sur, si vous obtenez une procuration d&#8217;un copropri\u00e9taire qui d\u00e9sire que vous le repr\u00e9sentiez, vous aurez alors le droit d&#8217;assister et de prendre parole \u00e0 l&#8217;assembl\u00e9e.
